An importer's shipment of goods subject to an absolute quota arrives after the quota for the period has filled. The importer wants to keep the goods for the U.S. market. What may it do with them under 19 CFR 132.5?
Absolute quota merchandise imported in excess of the quantity admissible must be disposed of under 19 CFR 132.5(c): it may be held for the next quota period in a foreign-trade zone or under a warehouse entry, or exported or destroyed under CBP supervision (132.5(a), (c)). There is no over-quota rate for an absolute quota; that option exists only for tariff-rate quotas (132.5(b)). Source: 19 CFR 132.5(a), (c) (eCFR, as at 7 Oct 2026).
Treating an absolute quota as if a higher rate let the goods in.
