Which ocean cargo unloaded at a covered US port is exempt from the harbor maintenance fee?
19 CFR 24.24(c) lists exemptions, including bunker fuel and ship's stores, freshly caught fish not previously landed, certain Alaska, Hawaii and possession movements, and cargo entering the US in bond for transportation and direct exportation to a foreign country (with special conditions for Canada and Mexico). Duty-free status, FTZ admission and Chapter 98 treatment do not exempt cargo from HMF, although several of them exempt goods from MPF. Source: 19 CFR 24.24(c)(1)-(6), 24.23(c) (eCFR, as at 7 Oct 2026).
Assuming duty-free or MPF-exempt goods are also HMF-exempt.
