CBLE Appeals: The 57-Point Threshold and How an Appeal Works
If you fail the CBLE you may appeal, but from the April 2026 exam only if you scored 57 or more of 80, and only on up to four questions (CBP "How to Appeal", checked 12 Oct 2026).
The rules
- First appeal: within 60 days of the results letter (19 CFR 111.13(f); CBP).
- Second appeal: within 60 days of the first appeal decision.
- Only questions where you chose an answer and did not get credit can be appealed.
- Argue in your own words why your answer is the best one, or why no answer is correct, with citations.
- You may retake the next exam while an appeal is pending; decisions may not arrive in time.
Why CBP added a threshold
CBP says about 70% of questions are appealed after each exam, and that 97% of those who passed on first appeal were within three questions of passing. It also points to fewer answer options and pre-exam legal review as reasons appeals succeed less often.
