CBP notifies an importer on Tuesday, July 7, 2026 that it has detained suspected piratical copies of a recorded copyright. If the importer wants to stop CBP from disclosing unredacted photographs of the goods to the copyright owner, by when must it provide information showing the goods are not piratical?
Under 19 CFR 133.42(b)(2)(i)(B), effective August 23, 2024, CBP may disclose information appearing on the detained goods, including unredacted photographs, to the owner of the recorded copyright unless the importer provides information within seven business days of the notification establishing that the goods are not piratical. Seven business days after Tuesday, July 7, 2026 is Thursday, July 16 (no federal holiday intervenes). July 14 counts calendar days; August 6 is 30 days. Source: 19 CFR 133.42(b)(2) (eCFR, as at 7 Oct 2026); CBP Dec. 24-03 (effective Aug 23, 2024).
Counting seven calendar days instead of seven business days.
