Under 19 CFR 133.42 as amended effective August 23, 2024, CBP detains a shipment of DVDs it suspects are piratical copies of a copyright recorded with CBP. Within what period must CBP notify the importer of the detention?
19 CFR 133.42(b)(2)(i), revised by CBP Dec. 24-03 (89 FR 52373, June 24, 2024, effective August 23, 2024), requires CBP to notify the importer in writing within five business days from the decision to detain (see also 151.16(c)). The detention may last up to 30 days from presentation (133.42(b)(1)). Seven business days is the importer's window to show the goods are not piratical before CBP discloses unredacted information to the copyright owner.
